Employee w-2 verse 1099- Miscellaneous... my employer had me sign a contract saying I was an Independent Cont?

An accountant friend said that is not the right clification, so I did the research and found out I should have been an employee. As a dance teacher I can instruct with my own style, but am given the student list, time to teach, do no advertising, have no investment in the business, and she fires teachers she doesnt like. I asked the owner and they said no your not employee, then treated me terrible, I have since quit and am thinking of doing an SS-8. Can't the employer lie when they fill out the form to have it look their way? How long is the process? Thanks so much.
